Granite Productions has a long history of successful projects and has worked for a wide range of clients including individuals, agencies, businesses and corporations. You can expect a friendly, professional and competitive service.We will be pleased to discuss your project requirements including contractual arrangements. Unless otherwise agreed Granite Production's Terms and Conditions are as follows; Work will normally be undertaken in accordance with an agreed job specification. This job specification will describe the work to be undertaken, the timescale of the work and the deliverables. The job specification will be assumed to be a complete description of the work to be undertaken. Any further work requested by the client outwith the job specification will be deemed as additional work and may incurr additional fees. Work will normally be undertaken on a fixed fee basis. Prior to commencing the work a schedule of fees and defined payment milestones will be agreed. Invoices will be raised on completion of these milestones. Where work is undertaken on an hourly rate or dayrate basis, an invoice will be raised on a weekly basis. VAT will be applied to invoices as appropriate. Unless otherwise agreed, payment shall be made within thirty days from the date of invoice. Payment not received within that time will be subject to an interest charge of 2.5% per month. All material expenses relating to the job shall be invoiced to the client, plus a 10% administration charge. All courier & travel expenses relating to the job shall be invoiced to the client, plus a 10% administration charge. These terms and conditions are governed by the law of Scotland and may not be varied unless agreed by both parties. If an estimate is requested prior to Granite Productions receiving full details of the work, it should be understood that this is not binding and may differ after Granite Productions has received full details of the work. In cases where the client is a new introduction, a percentage of the payment shedule may be requested prior to commencing work. Granite Productions retains ownership of the copyright (Copyright Designs and Patents Act 1988). Ownership of copyright is not affected by purchase of the original artwork.The client is granted a license to reproduce the artwork solely for the purposes agreed. The license is only granted upon payment in full of the fee specified on the payment terms. Any attempt to reproduce the artwork without such payment, will be regarded as a breach of copyright. Granite Productions retains the right to use the artwork for self-promotion. Granite Productions retains ownership of the work including original artwork, computer data and source files unless agreed in writing between Granite Productions and client. A further fee may be negotiated, should ownership of the work by the client be required. The license granted is exclusive to the named client. The license may not be sub-licensed to a third party.The client is responsible for the clearing of any copyright or reference material supplied and shall indemnify Granite Productions against any claims arising from materials thus provided. Granite Productions can only adhere to agreed deadlines and delivery milestones if there is no delay in the approval of review content or in the supply of reference material. Granite Productions shall not be held responsible for any consequential loss arising from the late delivery of artwork. If the work is cancelled by the client before delivery of any review content, 25% of the total agreed fee shall be payable, 100% of the agreed fee if cancelled by the client on delivery of the finished artwork or if the client uses the artwork for the purposes commissioned. Invoices raised against completion of agreed milestones shall be payable in full. If Granite Productions has correctly followed the commission in accordance with the agreed job specification, and the work is consistent with that of Granite Productions's portfolio, and with that shown to the client, then Granite Productions will be deemed to have completed the work. The client has no right to reject the work on the basis of style or composition. In the event of cancellation or rejection of the work, all rights in the work shall remain the property of Granite Productions. |
